BOOKING POLICIES
This website is operated by Mary Collins. Throughout the site, the terms “we”, “us” and “our” refer to Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd. Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
1. A booking with Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd and the "Intuitive Healing retreat is confirmed when the full amount is paid.
1.1 Guests must obtain full travel insurance within 14 days of booking the retreat covering all medical expenses, retreat activities and a trip cancellation policy in the unlikely event that the retreat is cancelled or in case of a personal emergency that will prevent you from attending.
1.2 The guest is responsible to pay for all extra services not included in the selected retreat package. This includes flights, transfers, travel insurance and any sightseeing activities that are not part of the retreat program.
1.3 The retreat is a "Wellness and Health" themed retreat. Therefore, there will be a "No Smoking" Policy at this retreat.
*CANCELLATION POLICY
2.It is the responsibility of the guest to read and understand our cancellation policy before making a reservation.
2.1 In the event of cancellation by the guest, regardless of the circumstances.
2A. The payment is non-refundable but may be transferred to another retreat or to a friend if 30 days notice is given.
2B. We do not offer credit for a guest arriving late or leaving early. This includes unforeseen issues such as family-related illness, or COVID diagnosis.
LIABILITY
3. Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd shall not be liable for any unusual and unforeseeable circumstances beyond our normal control, which the consequences of could not have been avoided even when exercising all due care. Such circumstances or events include, but are not limited to, pandemic outbreak, war or threat of war, riot, civil unrest, industrial disputes or strikes, accidents or failure to perform by third parties, including suppliers and subcontractors, unavoidable technical problems with the accommodation, transport or closure or congestion of airports, terrorist activity, natural disasters, industrial disasters, fire, theft, flooding and adverse weather conditions. In the event of any the above, refunds and compensation payments cannot be made.
3.1 Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd accepts no liability for loss, damage, injury or illnesses which may be received during the guest’s stay or travelling to and from CHANGE retreats.
3.2 Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd is not liable for any injuries or losses to guests, in the use of retreat facilities or participation in activities.
3.3 While all care is taken, Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd cannot accept any responsibility for loss or damage of personal possessions or valuables of guests.
3.4 All guests must take responsibility for their own medical and physical fitness and able to use retreat facilities and participate in activities.
ATTENDEE CONDUCT AT RETREATS
4. We reserve the right to remove attendees who do not comply with the proper registration, security procedures or requirements of attendee conduct outlined below at any point during a retreat without a refund.
4.1 Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd reserves the right to remove anyone who disobeys any requirements, procedures, policies or regulations of the retreat.
4A. You must not defame, abuse, harass, harm or threaten others, make any bigoted, hateful, or offensive statements.
4B. You may not advocate illegal activity or discuss illegal activities with the intent to commit them or cause injury or property damage to any person.
4C. You may not post or distribute any material that infringes and/or violates any right of a third party or any law or post or distribute any vulgar, obscene, discourteous, or indecent language or images.
4.C If we deem any online, social networking, or other media reference post, article, photo or video regarding a yoga retreat inappropriate, the offender is required to take down the material immediately upon our request for removal. If the posting is made during a yoga retreat, this may be grounds for dismissal from the retreat, removal and preclusion from the sites and future involvement in CHANGE Retreats.
4.D Without limitation of the foregoing, Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd may, in its sole and absolute discretion, remove You or any other attendee from the retreat, without explanation, either before or during a retreat, if such attendee engages in any unlawful, unauthorized, prohibited, improper, or unethical activities, or any other acts or omissions that we deem worthy of Your removal from the retreat.
4.2. The retreat is a "Wellness and Health" focused retreat. Guided Meditations and other calming practices will be applied, therefore it is expected that at certain points during the day all media and social devices are to be put on silent.
4.3. During Meditations it is expected that attendees whether participating in the activities or not, to be mindful of others and keep conversation in and around the area to a minimum.
PRICES AND SCHEDULES/ITINERARIES
5. Prices and Schedules/Itineraries as shown on the website are subject to change. We reserve the right to change retreat/day trip/event prices, or prices of individual add-on components, without prior notice. Existing bookings that have been paid for in full, or for which a deposit has been paid, will keep their original price as per the invoice.
5.1. We reserve the right to change our original retreat/day trip/event program and schedule, or individual services due to extraordinary circumstances s (e.g. external forces, governmental regulations, delays of third parties, weather and oceanic conditions, etc.). Retreat/day trip/event schedules and itineraries, including any activities and workshops included, can change at any time without notice.
5.2. We reserve the right to change the retreat/day trip/event location due to unforeseen issues (e.g. third party delays or problems, construction, etc.). We will ensure the standard is kept the same in all the partnering venues.
5.3. The price of a venue or individual services by third parties and any components therein is subject to change at the discretion of the third party supplier offering any goods or services contained in your booking request. The Fees displayed with respect to an Itinerary will be current at the time you make the booking.
5.4 To the extent permitted by law, neither Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd nor any of its directors, partners, employees or contractors accept any liability for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third-party providers over whom we have no direct control and is not preventable by reasonable diligence on our part.
5A. As the retreat operator, we make arrangements with other parties to provide you with some of the services on your retreat. These parties are independent suppliers over whom we have no direct control. Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd holds no responsibility for independent contractors (or weather conditions) changing services on the retreat.
5B. Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd is not responsible for any claims, losses, damages, costs or expenses arising out of injury, accident or death, damage, loss or delay of baggage or other property; or delay, inconvenience, loss of enjoyment, or frustration, whether physical or mental resulting from: (1) the act or omission of any party including Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd or its employees; (2) mechanical breakdown, government actions, weather or other factors beyond our control; (3) your failure to read information provided and follow instructions including, but not limited to, obtaining sufficient travel protection & health insurance and providing correct & complete personal, health and travel information; (4) your cancellation or change for any reason in travel services offered; and (5) your medical or health problems or physical disabilities.
5.5. You acknowledge that you voluntarily take part in any retreat, day trip or local event, and in any activities, classes and excursions arranged by us, retreat venues, organisers or third-party hosts, and insofar as legally permissible, waive your right to hold any of the organisers responsible for any loss or damage to person or property that occurs during our retreats.
5.6. Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd reserves the right to change this policy at anytime. The current policy is always applicable.
5.7 It is your responsibility to check the details contained in your booking confirmation, including your full name(s), the dates and location of your Retreat/Day Trip/Event (as applicable) before confirming and providing payment of the applicable fees.
5.8. We act as your retreat planner to book your retreats, day trips and events, and our Services are subject to Third Party Terms. By agreeing to these Terms, you hereby authorise us as your agent to: make the bookings on your behalf; and arrange the relevant contract between you and each third party service provider. Any Retreat/Day Trip/Event Itinerary booked by you is subject to Third Party Terms and, subject to these Terms, your legal right with regards to any aspect of the Retreat/Day Trip/Event is between you and the party identified in the Third Party Terms and E.U Law.
5.9. Third parties who are not our employees or our direct contractors including but not limited to suppliers of any goods or services offered under a Retreat/Day Trip/Event will be your responsibility. Such third parties reserve the right to cancel and reschedule your booking due to unforeseen circumstances. To the fullest extent permitted by law, we are not responsible for the products or services provided, or any change or cancellation, by those third parties.
6. Participants must notify Mary Collins/CHANGE Retreats of any dietary restrictions and allergies at the time of booking. Please note: as we work with several retreat venues, hotels and resorts, we might not be able to cater to all food restrictions. Please check with us prior to making full payment and we will check with the venue for you.
6.1 Room Damages
If you damage your room or any of the property within your room we will automatically deduct the cost of repairing / replacing / redecorating from your registered card.
6.2 By submitting a booking request, and confirming your booking, you automatically agree to our Liability Waiver:
In consideration of the services of Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd, their agents, owners, officers, volunteers, participants, employees, service suppliers and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as “Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd”), you hereby agree to release, indemnify, and discharge Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd, on behalf of yourself, your children, parents, your heirs, executors, administrators, assignees, personal representatives and estate as follows:
A. You acknowledge that some activities and traveling entails known and unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. You understand that such risks simply cannot be eliminated without jeopardising the essential qualities of the activity. Your participation in all activities is purely voluntary, and you expressly agree to assume the risk of injury or damage while participating in all activities during your retreat/day trip/event and are not grounds for a refund or discount. Furthermore, CHANGE Retreats guides and instructors have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant’s fitness or abilities. They might misjudge the weather, the elements, or the terrain. They may give inadequate warnings or instructions, and the equipment being used might malfunction.
B. Accordingly, you agree that you are voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss of personal property. You expressly agree and promise to accept and assume all of the risks existing in the practice of meditation, hypnosis, yoga, etc. and acknowledge that Mary Collins and all staff are not medical practitioners
C. You certify that you have adequate travel protection insurance should you need to cancel or change your travel plans and you certify that you have adequate health insurance to cover any injury or damage you may cause or suffer while participating in any of the activities, or else you agree to bear the costs of such injury or damage myself. You further certify that you are willing to assume the risk of any medical or physical condition you may have.
D. You hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd, its officers, employees and suppliers against all claims of losses, causes of action, damages or expenses of claim and against any costs including legal fees that may be incurred as a result of any such claims losses, damages or expenses whether valid or not, including any such claims which alleged negligent acts or omissions of Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd.
E. Should Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, you agree to indemnify and hold them harmless for all such fees and costs, and you declare to not take any legal action in any country.
F. You are responsible for any damage that may occur at the participating venue during your stay and may be invoiced by the venue accordingly.
G. You acknowledge that if anyone is hurt or property is damaged during your participation on a retreat/day trip/event, you may be found by a court of law to have waived your right to maintain a lawsuit against Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd on the basis of any claim from which you have released them herein. This is to certify that Mary Collins / CHANGE Hypnotherapy /LifeHakx Ltd its employees & suppliers are released from any responsibility for any loss, mishap, accident, injury or death that may occur during my participation at Intuitive Healing CHANGE Retreat..
H. You acknowledge that retreat photographs and images which include you can be published by Retreat Here for the company’s marketing purposes only.
DISCLAIMER
7. The hypnotherapist is neither a trained psychologist nor a medical doctor. At no time will the hypnotherapist attempt to
provide medical or mental health therapy. The client affirms that hypnotherapy is appropriate for them and does not
conflict with existing medical or psychiatric treatment and a medical waiver from a doctor and/or psychiatric doctor may
be required. Always follow the advice of your doctor or other professional medical practitioner. They further understand
that hypnotherapy is a treatment and not represented as a cure.
WARRANTY
8. No warranty is given, expressed or implied, for satisfactory results from the hypnosis sessions.
COMPLAINTS
9. If you have any feedback or a problem during your retreat, please inform the retreat leader immediately and he/she will endeavour to resolve your issue. Please note that we are not responsible for the individual behaviour of any group member or guest sharing your room/accommodation.
9.1. If there is a dispute between the Parties in relation to these Terms, the Parties agree to the following dispute resolution procedure:
9A) The complainant must tell the respondent in writing, the nature of the dispute, what outcome the complainant wants and what action the complainant thinks will settle the dispute.
YOUR OBLIGATIONS AND WARRANTIES
10. You warrant that throughout the term of these Terms that:
10A) there are no legal restrictions preventing you from agreeing to these Terms; 10B) you will cooperate with us and provide us with information that is reasonably necessary to enable us to perform the Services as requested by us from time to time, and comply with these requests in a timely manner. Such information may include but is not limited to your name, gender, contact details, payment details, passport details and the passport details of a co-host; 10C) the information you provide to us is true, correct and complete; 10D) you will not infringe any third party rights in working with us and receiving the Services; 10E) you will inform us if you have reasonable concerns relating to our provision of Services under these Terms, with the aim that we and you will use all reasonable efforts to resolve your concerns;10 F) you are responsible for obtaining any consents, licences and permissions from other parties necessary for the Services to be provided, at your cost, and for providing us with the necessary consents, licences and permissions; 10G) you consent to the use of your name and Intellectual Property in relation to the Services in a way which may identify you;
11. DATA USE AND PROTECTION
The guest agrees that she may be photographed and/or filmed during her stay and/or activities in connection with the company, and also agrees that the company may use such recordings for promotion and/or advertising purposes without any prior consent.
